RIYADH — The Higher Administrative Court under the Board of Grievances issued a judicial principle stating that recording a notification about absence of an employee from work is neither a reflection of the obligation between the worker and the employer, nor it is part of the obligation. The Board of Grievances is an independent administrative judicial body in the Kingdom. The ruling was issued by the court at the end of the first quarter of the current Hijri year 1444. President of the Board of Grievances and Chairman of the Administrative Judicial Council Sheikh Khalid Al-Youssef has issued a directive to circulate this ruling to the heads of administrative courts and inform it to whoever is necessary. It was stated in the ruling that the notification of absence from work does not deviate from the administrative decisions of the courts affiliated to the Board of Grievances that have the jurisdiction to examine lawsuits filed seeking cancellation of report of absenteeism, in accordance with Article 13/b of its law. It is noteworthy that Article 58 of the Law of Pleadings before the Board of Grievances outlined the mechanism for the Higher Administrative Court to adjudicate in the matter of jurisdiction in a way that guarantees maintaining judicial stability.
