Saudi Arabia, Iraq sign extradition agreement

RIYADH - The Kingdom of Saudi Arabia and the Republic of Iraq signed here Sunday an extradition agreement for their respective citizens requiring imprisonment.
The agreement was signed by Dr. Mohammed Bin Abdul-Karim Al-Essa, Minister of Justice, and Hassan Halbous Al-Shammari, his Iraqi counterpart.
The agreement stipulates that the accusing country will hand over the convicted person to the country where the verdict will be implemented at an agreed time and place. The accusing country will bear all the expenses for transporting the convicted person to its territories while the other party will bear all the expenses for transporting the convicted person on its territories, provided the two parties do not agree to different terms.
The penalty stated in the verdict will be implemented without any amendments.
The penalty will be implemented according to the executive regulations in force in the country implementing the verdict and that country alone has the right to take all decisions related to how they are implemented. The period of precautionary detention will be deducted from the penalty, aside from the period the sentenced person spent in custody in the accusing country.
The rules of general and private amnesty issued in the accusing country will apply to the convicted person. But such an amnesty issued in the country where the sentence is being carried out does not apply to the convicted person unless the accusing country agrees to this in writing.
The accusing country will immediately inform the implementing country of any decision or measure issued in its territories that will prevent implementation of the penalty in full or in part. The authorities concerned in the implementing country will carry out these decisions immediately. The implementing country will stop carrying out the verdict if it is informed by the accusing country of any decision that prevents this from happening.
The accusing country alone has the legal and judicial right to take any measures to reconsider the verdict issued. Each of the two parties will inform the other speedily on the judicial verdicts issued in its territories against citizens of the second party while clearly mentioning the period of incarceration.
The two countries will inform each other of the arrest of any of their citizens. The agreement comes into force 30 days after the exchange of the diplomatic memorandums.
