On Tarwiyyah day From where does the Haj pilgrim assume Ihram on the day of At-Tarwiyyah? He assumes Ihram from his place just as the Companions of the Prophet (peace be upon him) assumed Ihram from their places in Al-Abtah during the Farewell Haj, according to the order of the Prophet (peace be upon him). Likewise, whoever is inside of Makkah, he assumes Ihram from his place. This is due to the previous Hadith of Ibn Abbas (may Allah be pleased with him) which contains the Prophet's statement: “And whoever is within that” – meaning within the boundaries of the Maawaqit – “then his place of assuming Ihram is from his people (i.e., his home). Even the people of Makkah assume Ihram from Makkah.” (Al-Bukhari and Muslim) Sheikh Bin Baz Fatawa Islamiyah, vol. 4, p. 120 Ihram at Meeqat What is the ruling on whoever passes the Meeqat without assuming Ihram and has intended Haj or Umrah? Whoever passes the Meeqat for Haj or Umrah and did not assume Ihram, then it is obligatory upon him to return and assume Ihram for Haj and Umrah from the Meeqat. This is because the Messenger of Allah (peace be upon him) ordered that. She did not perform her obligatory Haj. Some of her heirs want to designate someone to perform Haj on her behalf before the shares of her inheritance are distributed. Others do not agree to this unless a legal ruling has been sought on this issue. Spending the night in Mina is not required for the people with valid excuses. However, they must take advantage of the rest of the time by staying in Mina with the Haj pilgrims.
